◆ 국문초록

북한은 2022년 2월 「해외동포권익옹호법」을 제정하였다. 「해외동포권익옹호법」은 북한이 ‘해외에 사는 동포’로 규정한 ‘해외동포’의 신분과 권익을 규정한 최초의 법으로 김정은 체제의 해외동포 정책의 방향과 내용을 종합적으로 규정하였다. 북한이 「해외동포권익옹호법」을 제정한 이유는 다섯 가지로 판단된다.

첫째, 해외동포 정책과 관련한 제반 규정을 종합적으로 정리하여, 법적 구속력을 높이기 위한 목적이다. 해외동포 관련 법을 종합적이고 체계적으로 정리하였다. 둘째, 김정은을 수령으로 공식 추대에 맞추어 해외동포 사회에 새로운 지도자 김정은의 위상을 제고하기 위한 목적이다. 셋째, ‘해외동포’ 전체를 대상으로 한 법을 제정함으로써, ‘조선’ 국적과 관계없이 해외동포 문제 개입할 수 있는 법적 근거를 마련하였다. 넷째, 경제적인 목적이다. 해외동포의 투자를 보장하고, 특혜와 우대를 명시하였다. 다섯째, 대한민국 재외동포 정책 대응이다. 해외동포 권익, 정치적 문제, 경제 투자와 관련한 사항을 규정함으로써, 남한의「재외동포기본법」에 대응하는 법을 마련한 것이다.

◆ Abstract

In February 2022, North Korea enacted the "Overseas Koreans Rights Protection Act". The "Overseas Koreans Rights Protection Act" uses the concept of "overseas Koreans" in South Korea, which North Korea defines as "Korean residents living abroad," as "overseas Koreans" in North Korea. Since this study aims to analyze North Korea's "overseas Koreans" policy and the "Overseas Koreans Rights Protection Act," the term "overseas Koreans" will be used in this study. Terms related to "overseas Koreans" will be analyzed separately in Chapter II.

As the first law to regulate the status and rights of, it comprehensively stipulated the direction and contents of the Kim Jong-un regime's overseas Korean policy. There are five reasons why North Korea enacted the 「Overseas Koreans Rights Protection Act」.

First, the purpose is to increase legal binding power by comprehensively organizing all regulations related to overseas Koreans policy. Laws related to overseas Koreans are comprehensively and systematically organized. Second, it is aimed at enhancing the status of Kim Jong-un as a new leader in the overseas Korean society in line with the official appointment of Kim Jong-un as the leader. Third, by enacting a law for the entire 'overseas Koreans', a legal basis for intervening in overseas Koreans issues regardless of the nationality of 'Korean' was established. Fourth, it is for economic purposes. Investment of overseas Koreans is guaranteed, and preferential treatment and preferential treatment are specified. Fifth, it is the response to the policy of overseas Koreans in Korea. By stipulating matters related to the rights and interests of overseas Koreans, political issues, and economic investment, a law to respond to the Framework Act on Overseas Koreans was established.
